Lease template for a flat in Czechia

A lease for a flat, in Czech as you sign it, with English under each clause. Every clause links the section of the Civil Code it rests on. Fill it in for your flat and print it, or print it blank and fill it in by hand.

In short: a Czech lease (nájemní smlouva) must be written. It names the landlord, the tenants and the flat, how long the lease runs, the rent, the service charges and the deposit. The law protects the tenant: a clause that cuts the tenant’s rights is disregarded, so this template doesn’t print one and tells you why.

The lease template

The whole lease as it prints. Fill it in to make it the lease for your flat; anything you leave empty prints as a blank to complete by hand.

What you type stays on this page: it isn’t sent, stored or put in the address. Reloading the page clears it. The lease prints in Czech with English under each clause. Write names and addresses as they are in your documents.

What the template won’t put in a lease

These clauses turn up in leases, but the Civil Code disregards them: a clause that cuts a tenant’s rights doesn’t bind the tenant even when signed. The template leaves them out and says why.

  • Deposit left out: it’s over the cap

The deposit and any penalties in the lease together can be at most 3 months’ rent. Until the deposit fits, the lease leaves its sum blank.

  • Penalty left out: it’s over the cap

A penalty counts towards the same cap as the deposit: together, at most 3 months’ rent.

  • Other payment left out

Besides rent, service charges and the deposit, a landlord may not ask the tenant for any payment, whether it’s called a fee, a contribution or a second deposit.

  • Due day moved to the law’s

Rent is due by the 5th of the month at the earliest; an earlier day cuts the tenant’s right and is disregarded, so the lease says the 5th.

  • Rises at the landlord’s will left out

Rent rises only by a yearly increase written into the lease, by agreement, or by the law’s procedure (at most 20% over 3 years, and a court decides if the tenant doesn’t agree). The lease says no yearly increase is agreed.

  • Pet ban left out

A tenant has the right to keep an animal as long as it doesn’t trouble the landlord or the neighbours beyond what’s fair for the house. A clause banning pets outright cuts that right and is disregarded, so the lease states the law’s rule.

  • Ban on subletting a room left out

A tenant who lives in the flat may sublet part of it without the landlord’s consent, and a ban on that is disregarded. The lease keeps the lawful part: no subletting while the tenant doesn’t live there.

  • All repairs on the tenant left out

The tenant does and pays only routine upkeep and small repairs; the rest is the landlord’s, and a clause saying otherwise is disregarded. The lease states the law’s split.

  • Access at any time left out

The landlord comes in after telling the tenant in reasonable time, and without notice only to prevent damage or in an emergency. A duty to let the landlord in at any time is clearly unfair and disregarded.

  • Shorter landlord’s notice left out

A landlord may end a lease only for a reason the law lists, with 3 months’ notice. A shorter notice, or one without a reason, is disregarded.

Next: the handover record for the day you get the keys, move-in costs for the cash you need that day, and ending a lease when it’s time to go.

Questions

Leases in Czechia, answered

Does a lease in Czechia have to be in writing?

Yes: the Civil Code asks for a written lease. But a landlord can’t use a missing written lease against the tenant, and once a tenant has lived in the flat for 3 years in good faith that the lease is valid, it counts as properly made.

How long does a lease run if no end date is set?

With no end date or term agreed, it runs until one side ends it by notice. The tenant needs no reason and gives 3 months’ notice. The landlord may give notice only for a reason the law lists, such as a serious breach or needing the flat for themselves or a close relative, also with 3 months’ notice. A lease with an end date ends on that day.

How much can a deposit (kauce) be?

The deposit and any penalties in the lease together can be at most 3 months’ rent. The landlord returns it when the lease ends, less only what the tenant owes from the lease, with interest at least at the statutory rate from the day it was paid.

Can a landlord ban pets or smoking in a lease?

Not pets outright: the law gives the tenant the right to keep an animal as long as it doesn’t trouble the landlord or the neighbours beyond what’s fair for the house, and a clause that cuts a tenant’s rights is disregarded. The tenant pays any extra upkeep of common areas the animal causes. Smoking is different: a lease may ban it inside the flat, as it may set other rules for using it.

When can the landlord enter the flat?

After telling the tenant in reasonable time, to inspect the flat as far as needed or to repair or maintain it; without notice only to prevent damage or in an emergency. In the last 3 months of a lease whose end day is known, the tenant lets people who may rent it next view it, with both sides there. A clause letting the landlord in at any time is disregarded.

Who pays for minor repairs in a rented flat?

The tenant pays routine upkeep and small repairs: those Government Regulation 308/2015 lists and any other repair costing at most 1,500 Kč, up to 150 Kč/m² of floor area in a calendar year. Everything else is the landlord’s, and a lease can’t put it on the tenant; it can put small repairs on the landlord.

Is a lease in English only valid?

The law asks for a written lease, not a Czech one, so a lease in a language both sides understand is valid. But offices and courts work in Czech and may ask for a translation. This template is in Czech with your language under each clause, and it says the Czech text decides.

Does a lease have to be registered anywhere?

No. A flat’s lease needs no office, stamp or notary to be valid. The owner may have it entered in the land registry, but that’s rare. A foreigner uses the signed lease as proof of accommodation for a visa or residence permit.
